Terms of Service

These Terms govern your use of Retouchly, operated by Zijlstra.tech (Archipelweg 111 D, Leeuwarden, the Netherlands; KvK 82728143). By using the service you agree to these Terms. If you do not agree, do not use Retouchly.

Eligibility

You must be at least 18 years old to use Retouchly, create an account or buy credits. By using the service you confirm that you meet this requirement.

What the service does

Retouchly edits photos you provide using AI, for example removing people or objects, restoring old photos or changing a background. Results are AI-generated and can contain mistakes. They are not evidence of how something or someone really looked, and must not be presented as such.

Your photos and permissions

You may only upload photos that you own or have permission to use, and only edit people who agree to the edit. If a child appears in a photo, you confirm that you are their parent or legal guardian, or have their permission. You keep all rights in your photos. You give us permission to process them only as needed to provide the edits you request. You are responsible for the photos you upload and for how you use the results.

Acceptable use

You may not use Retouchly for sexual or nude content, sexualised depictions of anyone, edits of minors’ bodies, fake documents or proof, deceiving or harassing people, impersonation, or anything unlawful. The full rules are in our Acceptable Use Policy, which is part of these Terms. We may refuse edits and suspend or end access for violations.

Previews, credits and payment

Previews are free and watermarked: 3 a day without an account and 10 a day with a free account. We may change these limits. One credit unlocks the full-quality, watermark-free version of one edit. Credits are added after your payment is confirmed, do not expire, have no cash value and cannot be transferred.

Payments are handled by Stripe. Prices are shown in euros and are final: Zijlstra.tech uses the Dutch small business scheme (KOR), so no VAT is charged.

Full-quality results are kept for 24 hours after you create them. Download unlocked results within that time; afterwards they are deleted and cannot be recovered.

Right of withdrawal and refunds

At checkout you ask us to deliver your credits right away and acknowledge that you lose your 14-day right of withdrawal for credits you use. Unused credits can be refunded within 14 days of purchase. Details are in our Refund Policy.

Rights in edited images

Subject to these Terms, you may use the images you create for personal and commercial purposes. You are responsible for making sure your use does not infringe anyone else’s rights, including copyright, privacy and portrait rights.

Privacy

Our Privacy Policy explains how we handle your data, including your photos, and when it is deleted.

Disclaimers and liability

The service is provided “as is”. To the extent permitted by law, Zijlstra.tech is not liable for indirect or consequential losses, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or your mandatory consumer rights.

Changes and termination

We may update these Terms as the service evolves and will change the “Last updated” date above. We may suspend or end the service, or your access, where reasonably necessary. You may stop using Retouchly at any time.

Governing law

These Terms are governed by Dutch law, without affecting the mandatory consumer protections of the country where you live.
